Agreement to these terms

These Terms of Service govern your use of www.tovargaragedoors.com, operated by Tovar Garage Doors & Openers LLC. By browsing the site or submitting the estimate form, you agree to them. If you do not agree, please do not use the site.

They sit alongside our Privacy Policy, which explains how we handle your information.

What this website is

This site describes our services, shows examples of our work, and gives you a way to reach us. The descriptions, photographs, timeframes and prices on it are for general information.

Nothing on this website is a binding offer, a quote, or a guarantee of price, availability or result. Photographs show past work and are not a promise that your job will look identical.

We try hard to keep the site accurate and current, but we do not warrant that every detail is free of errors or omissions, and we may change or remove content at any time without notice.

Estimates, pricing and promotions

Estimates are free, and we put the price in writing before work begins. That written estimate, not this website, is the price you are agreeing to.

• An estimate is based on what we can see and on the information you give us. If the work turns out to involve something we could not have known about, such as hidden damage, a non standard opening, or framing that has to be corrected, we will tell you and agree the change with you before we do it.
• Written estimates are valid for the period stated on them. Material prices move, and an old estimate may need to be refreshed.
• Promotional offers, including any tune up or seasonal pricing advertised on this site, are limited time, may have eligibility conditions, apply to the advertised service only, cannot be combined with other offers unless we say so, and can be changed or withdrawn at any time. Discounts such as military and senior discounts require eligibility and should be mentioned when you book.

Requesting service through the site

Submitting the estimate form is a request, not a booking, and not a contract. No work is scheduled until we have spoken with you and confirmed it. We may decline any request.

You agree that the information you give us is accurate, that you are at least 18 years old, and that you either own the property or are authorised by the owner to have the work done on it.

By providing your phone number you agree that we may contact you about your request, including by call and text, as described in our Privacy Policy.

Work, warranties and scheduling

The terms that actually govern a job, including scope, price, payment, and any workmanship warranty, are the ones set out in the written estimate, work order or invoice we give you for that job. Where anything on this website conflicts with those documents, those documents control.

Manufacturer warranties on doors, openers and parts are provided by the manufacturer on their terms, and we pass through whatever coverage the manufacturer offers. We are not the manufacturer and cannot extend or alter their warranty.

We answer the phone around the clock and we move fast on emergencies, but arrival times, same day service and completion timeframes are good faith estimates rather than guarantees. Weather, parts availability, traffic and the condition of the existing installation all affect them.

A safety warning about garage doors

Any general guidance on this site is educational and cannot account for your particular door, spring type or opening.

Garage door springs and cables hold enormous stored tension and cause serious injuries every year. Do not attempt to adjust, release or replace springs, cables or drums yourself. Please call a professional, whether that is us or someone else.

You act at your own risk if you rely on information from this site to work on a door yourself.

Acceptable use

You agree not to use this site to submit false or fraudulent requests, send spam or automated submissions, attempt to gain unauthorised access to the site, its server or its data, interfere with its operation, scrape or harvest content or contact details, or use it for anything unlawful. We may block access to anyone who does.

Content and trademarks

The design, text, photographs of our work, and the Tovar Garage Doors name and logo belong to Tovar Garage Doors & Openers LLC and are protected by copyright and trademark law. You may view, print and share pages for your own non commercial use. You may not copy, republish or reuse the site's content or photographs commercially without our written permission.

Brand names mentioned on this site, including Amarr, Wayne Dalton, CHI, Doorlink, Clopay, LiftMaster, Chamberlain, Genie and Craftsman, are the trademarks of their respective owners. We reference them to describe the products we install and service. That reference does not imply that those companies endorse or are affiliated with us.

Testimonials on this site come from real customers and reflect their individual experience. Names may be shortened for privacy. One customer's result is not a promise of the result you will get, since every door, home and job is different.

Disclaimer

Limitation of liability

To the fullest extent permitted by Texas law, Tovar Garage Doors & Openers LLC and its owners and employees will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising out of your use of this website or your reliance on information published on it, even if we have been advised that such damages are possible.

Our total liability arising out of the website is limited to one hundred dollars (US$100). Liability arising out of work we perform for you is governed by the written agreement for that work and by applicable Texas law.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

Indemnification

You agree to indemnify and hold harmless Tovar Garage Doors & Openers LLC and its owners and employees from claims, damages and reasonable legal costs arising out of your misuse of this website, your breach of these terms, or your violation of the rights of anyone else.

Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute arising out of these terms or your use of this website will be brought exclusively in the state or federal courts located in Johnson County, Texas, and you consent to the jurisdiction of those courts.

Before anything formal, please call us. Most problems are a misunderstanding and take one phone call to fix.

General

If any provision of these terms is found unenforceable, the rest stay in force and the unenforceable provision is applied to the maximum extent permitted. Our failure to enforce a provision is not a waiver of it. These terms, together with our Privacy Policy and any written agreement for work performed, are the entire agreement between us about this website.

We may update these terms at any time. The version on this page, with the effective date at the top, is the one that applies. Continuing to use the site after a change means you accept it.
